2. The following supplementary agreement is made:
The following diagnoses on long-term therapeutic needs according to Section 32 (1a) SGB V, established by the Federal Joint Committee (G-BA) on May 19, 2016 with effect from January 1, 2017
1.) Heriditary lymphedema
2.) Lymphedema stage III (elephantiasis)
will be canceled in the period from 01.01.2017 until corresponding resolution of the Joint federal committee on these diagnoses recognized by the partners of the framework according to § 106b paragraph 2 SGB V on the basis of ICD-10-GM 2017 as special requirement for regulation as follows: ( see table )< p> The partners of the framework specifications agree that regulations that meet the aforementioned prerequisites in connection with the requirements according to Annex 2 § 3 of these framework specifications are to be recognized as regulations according to § 106b Paragraph 4 SGB V as early as 01.01.2017. This recognition is ruled out if the aforementioned requirements are not met.
3. Final clause
The agreement comes into force on 01.01.2017.
Item 2 loses its validity with the entry into force of resolution of the G-BA on the aforementioned diagnoses. There is an agreement between the parties to the agreement to confirm the expiry of section 2 immediately after publication of the G-BA decision in the Federal Gazette by means of joint declaration of annulment. This also applies expressly if the decision of the G-BA with regard to the diagnoses mentioned contains regulations that deviate from the aforementioned provisions (e.g. only regulates sub-area or larger scope).
